The Home Owners Association (HOA): Powell Butte Heights, located in South East Portland, Oregon was founded in 1996. This beautiful 76-home neighborhood has an active neighborhood association, many long-term residents, a myriad of age ranges and stunning views of Mt. Hood, Mt. St. Helens and many other local peaks. There is also HOA trail access to Powell Butte Nature Park, which features an abundance of wildlife for the nature enthusiast to observe and miles of trails to accommodate hikers, mountain bikers, and horseback riders. In short, Powell Butte Heights is a great place to live and raise a family!
The Board of Directors: Contact information for the board can be found on the Contact Us page. All members of the Board are volunteers supporting the Powell Butte Heights Homeowners' Association.
Governing Documents: The CC&Rs - short for Covenants, Conditions, and Restrictions - are set forth in a legally-binding document on file with the Multnomah County Recorders Office and should have been provided to homeowners at closing when they purchased their properties. They explain what homeowners may or may not do with their properties, and they cover such items as architectural review, maintenance, and assessments. The CC&Rs may be amended and refiled with the state.
The Bylaws serve the purpose of explaining how our HOA, a non-profit corporation, is run. They cover areas such as membership, the board of directors, and annual meetings. As with the CC&Rs, the bylaws have a provision for amendment.
The document Resolution for Enforcement of Regulations from 2011 states the precise authority the HOA Board of Directors have under Oregon law to levy fines and assessments and provides a schedule of fines.
Architectural Review: The primary activity of the Powell Butte Heights Board and Architectural Review Committee (ARC) is to implement the provisions outlined in Oregon Statute, and Article 6 of the Declaration of Covenants, Conditions and Restrictions for Powell Butte Heights Homeowners Association. In addition the ARC provides oversight to potential violations of other Articles of the Declaration, such as failure to maintain the exterior of the house or landscaping.
Any homeowner who believes there is a violation of one of the provisions of the Declaration may contact the Board of Directors. However, the complaining owner is encouraged to attempt to contact the Alleged Offending Owner and request that all such activities cease before submitting a complaint to the Board of Directors. If the Complaining Owner is uncomfortable contacting the Alleged Offending owner, a complaint may be submitted directly to the Board of Directors. The ARC will review the complaint to determine if any action is required and, if appropriate, the ARC will contact the homeowner in writing to inform them of the violation. The initial letter will request a response within a specified time period. If no response is received within the specified time period, the ARC will send a second letter advising action on their part is required immediately. After reviewing any responses from the homeowner, or the lack thereof, the ARC will then forward the information to the Board for appropriate follow-up.
